Protecting your private information is our priority. This Statement of Privacy applies to the www.settrax.com and Settrax LLC and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Settrax LLC include www.settrax.com and Settrax. The Settrax website is a medical software site. By using the Settrax website, you consent to the data practices described in this statement.

Collection of your Personal Information

Settrax may collect personally identifiable information, such as your name, address, and contact information. If you purchase Settrax’s products and services, we collect billing and credit card information. This information is used to complete the purchase transaction. We may gather additional personal or non-personal information in the future.

Information about your computer hardware and software may be automatically collected by Settrax. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Settrax website.

Settrax encourages you to review the privacy statements of websites you choose to link to from Settrax so that you can understand how those websites collect, use and share your information. Settrax is not responsible for the privacy statements or other content on websites outside of the Settrax website.

Use of your Personal Information

Settrax collects and uses your personal information to operate its website(s) and deliver the services you have requested.

Settrax may also use your personally identifiable information to inform you of other products or services available from Settrax and its affiliates. Settrax may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

Settrax does not sell, rent or lease its customer lists to third parties.

Settrax may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Settrax, and they are required to maintain the confidentiality of your information.

Settrax may keep track of the websites and pages our users visit within Settrax, in order to determine what Settrax services are the most popular. This data is used to deliver customized content and advertising within Settrax to customers whose behavior indicates that they are interested in a particular subject area.

Settrax will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Settrax or the site; (b) protect and defend the rights or property of Settrax; and, (c) act under exigent circumstances to protect the personal safety of users of Settrax, or the public.

Our Principles for Responding to Government Requests for User Data

Our team carefully reviews all requests for user data (e.g., subpoenas, court orders, and search warrants). Consistent with this approach and our commitment to defending our users’ privacy, we also:

  • Provide Notice to Our Users. Our policy is to explicitly notify our users about third-party requests for their information prior to disclosure and thereby provide them with an opportunity to challenge requests for their data. In some cases, we may be prohibited by law from doing so, such as when we receive a non-disclosure order pursuant to 18 U.S.C. § 2705(b). Additionally, in exceptional circumstances, such as imminent threats of physical harm to a person, we may elect to provide delayed notice. When the circumstance that prevented us from providing notice prior to disclosure is removed, e.g., the non-disclosure order expired or the threat has passed, we take steps to inform the affected user(s) that data was disclosed.
  • Restrict Disclosure of Content. We will only disclose content (e.g. email messages) with a search warrant or the user’s consent.
  • Minimize Disclosure of Information. We provide only that information which we are clearly obligated to provide by the legal process and as allowed by law. We will resist any overly-broad request for our users’ information. If we are required to provide information, we produce only limited information to satisfy the demand in order to protect our users’ privacy.

Our Requirements for Processing Government Requests for User Data

We comply with the Electronic Communications Privacy Act (“ECPA”), 18 U.S.C. §§ 2501 et seq., when responding to any request for our users’ data. We require adherence to the requirements of 18 U.S.C. § 2703 relating to the disclosure of basic subscriber information, content, and other customer records. All legal process submitted to us must be valid and comply with applicable substantive and procedural requirements for the issuance of that type of process. In addition to requiring that all requests for user data comply with ECPA and other applicable laws, we also require that:

  • The legal process specifically identifies the user account that is subject to the request by user ID, email address, screen name or another appropriate identifier. This will help us identify the particular account subject to the request. Requests to identify users based on real names or IP addresses may be declined.
  • All process must be submitted in writing unless applicable law specifically allows for an oral request. In such cases, we may ask for a written request after the fact.
  • All process must be on official letterhead and contain sufficient information to verify that the request has originated with an entity or individual authorized to make such request.

Use of Cookies

The Settrax website may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize Settrax pages, or register with Settrax site or services, a cookie helps Settrax to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same Settrax website, the information you previously provided can be retrieved, so you can easily use the Settrax features that you customized.

Settrax does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website.
